DIR 00 // SCOPE

About These Terms

These Terms of Service ("Terms") govern your purchase, download, and use of MousePlugins software and related services (the "Software" and "Services"). By purchasing, downloading, installing, or using the Software, you agree to these Terms.

If you do not agree, do not use the Software. No dramatics required.

DIR 01 // ACCESS

License Grant

Upon purchase, Stéphane Berger (trading as "MousePlugins") grants you a non-exclusive, perpetual license to use the Software. This is a license to use, not a sale of the underlying code or intellectual property.

  • Authorized for commercial and non-commercial audio production.
  • Permitted on unlimited devices you own or control for personal use (including your household/studio), provided you do not share the license key or make the Software available to others.
  • You may not rent, lease, sublicense, resell, or redistribute the Software or license keys.
  • Software is provided "as-is" without vendor gatekeeping or remote deactivation.

If you need more seats (studio machines, team environments), contact us and we'll solve it like adults.

DIR 02 // DELIVERY

Purchases, Downloads & License Keys

After purchase, we deliver a download link and a license key. Activation is performed locally by entering the license key. The Software does not phone home to validate your license and we do not receive activation events.

  • To buy the Software and receive delivery emails, you must be online. After that, operation is offline-first.
  • Keep your license key safe. If you lose access to the email address used at checkout, recovery may be difficult.
  • We may change download URLs over time for security and reliability, but your entitlement to the purchased version remains.
DIR 03 // COMPATIBILITY

Platform Restrictions

Compatibility is limited to the following platforms and plugin formats. It is your responsibility to verify compatibility with your DAW and system before purchase.

  • Windows: 10/11 (64-bit) VST3 and CLAP formats.
  • Linux: Modern x64 distributions (VST3 and CLAP).
  • macOS: Not available. Purchasing in the hope that Apple suddenly becomes pleasant is not a refund reason.
DIR 04 // MAINTENANCE

Updates & Support

Maintenance is handled per major version.

  • Updates within the same major version (e.g., v1.0 to v1.3) are included at no additional cost.
  • Major version upgrades will be clearly labeled and are not forced on you.
  • Support is email-based via support@mouseplugins.com.
  • Any diagnostic information is submitted manually by you. Do not send sensitive personal data unless you want to.
  • Support eligibility: support is provided for active licenses/orders. If an order has been refunded, direct support for that order/license is not available.
DIR 05 // SOVEREIGNTY

Zero-Telemetry Guarantee

Your privacy is a technical constraint of the Software.

  • No background analytics, usage tracking, or session reporting.
  • No mandatory "always-online" check-ins or account-based heartbeats.
  • License keys are stored locally and verified offline.

DIR 06 // RESTRICTIONS

Prohibited Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the Software except where such restrictions are prohibited by applicable law.
  • Remove or obscure copyright notices, branding, or license key mechanisms.
  • Distribute, publish, sell, or share the Software, installers, or license keys.
  • Use the Software in any unlawful way or to violate others' rights.
DIR 07 // REFUNDS

Refunds & Right of Withdrawal (EEA/UK Consumers)

If you are a consumer in the EEA/UK, you generally have a 14-day right of withdrawal for distance purchases. Because we sell downloadable software, we handle refund requests within that period in a straightforward way. This section explains our process and what happens to the license after a refund.

  • How to request a refund: email support@mouseplugins.com with your order reference (and the email used at checkout).
  • What we do: we will confirm eligibility, process the refund to the original payment method, and mark the related license as inactive.
  • After a refund: you must stop using the Software, delete all copies, and not make the Software or license key available to anyone else.
  • Support after refund: direct technical support is not provided for refunded orders/licenses (docs and public resources may remain available).
  • Defects / non-conformity: refunds do not affect your statutory rights if the Software is defective or not as described.
  • Abuse: repeated refund abuse may result in refusal of future sales or support, without limiting mandatory statutory rights.

We do not currently require a digital-content withdrawal waiver at checkout. If we ever add an option such as “immediate delivery + waiver” (where legally permitted), it will be presented explicitly during checkout.

DIR 08 // WARRANTIES

Disclaimer of Warranties

The Software and Services are provided "as is" and "as available". We do not warrant that the Software will be error-free, uninterrupted, or compatible with every system configuration.

Nothing in these Terms limits mandatory statutory guarantees that cannot be excluded under applicable law.

DIR 09 // LIABILITY

Limitation of Liability

To the maximum extent permitted by law, MousePlugins will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill.

Where liability cannot be excluded, our total liability for any claim relating to the Software/Services is limited to the amount you paid for the relevant product in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms limits liability for intent, gross negligence, or any liability that cannot be limited under applicable law.

DIR 10 // TERMINATION

Termination

These Terms remain in effect until terminated. We may terminate the license if you materially breach these Terms. Upon termination, you must stop using the Software and delete all copies in your possession or control.

DIR 11 // LAW

Governing Law

These Terms are governed by the laws of Spain, without regard to conflict of law principles. If you are a consumer, you may also benefit from mandatory protections of your country of residence.

DIR 12 // CHANGES

Changes to These Terms

We may update these Terms from time to time. If changes are material, we will update the "Last Updated" date and, where appropriate, provide a notice on the website. Continued use after changes take effect means you accept the updated Terms.
