End User License Agreement
This End User License Agreement and these Website Terms govern your access to our website, downloads, installers, trial versions, paid licenses, free products, manuals, update files, and related services.
By downloading, installing, purchasing, activating, or using any MousePlugins software, you agree to these terms.
If you do not agree, do not install or use the software.
Definitions
"MousePlugins," "we," "us," or "our" means Stéphane Berger / MousePlugins, the provider of the website and software.
"Software" means any audio plugin, standalone application, installer, demo, trial, manual, preset, update, beta version, or related file provided by us.
"License" means the right we grant you to use the Software under these terms.
"You" means the person or business downloading, purchasing, installing, or using the Software.
"Website" means mouseplugins.com and any related pages, download areas, account areas, product pages, checkout pages, manuals, support pages, or documentation.
License grant
When you purchase or download Software from us, we grant you a limited, non-exclusive license to install and use the Software in accordance with these terms.
Unless a product page, invoice, bundle, promotion, or separate written agreement says otherwise, one license may be used by one person or one legal entity on computers owned, controlled, or primarily used by that license holder.
For personal users, this includes your own household or studio machines, provided you do not share the license key or make the Software available to others.
For teams, studios, companies, schools, or shared workstations, additional seats or a separate written license may be required.
You may use the Software for personal, professional, educational, and commercial music/audio production.
You may create, publish, sell, stream, broadcast, distribute, or otherwise exploit audio works made with the Software. We do not claim ownership of your music, sounds, mixes, masters, presets made from scratch, or other creative output.
What you may not do
You may not:
- Share, rent, sublicense, lend, lease, or transfer your license key or licensed Software to another person without our written permission, except where such restriction is not permitted by applicable mandatory law.
- Upload licensed installers, plugin files, license keys, or protected downloads to file-sharing sites, public repositories, forums, Discord servers, marketplaces, or similar places.
- Reverse engineer, decompile, disassemble, crack, patch, bypass, or tamper with license checks, trial limitations, copy protection, or installer logic, except where such restriction is not permitted by applicable law.
- Remove copyright notices, trademarks, license notices, or ownership information.
- Use the Software to build or distribute a competing product by copying our code, user interface, presets, documentation, branding, product identity, or protected assets.
- Use the Website or Software for illegal activity, malware distribution, fraud, harassment, or attempts to interfere with our systems.
- Misrepresent yourself as MousePlugins, an official reseller, an employee, or an authorized representative.
Ownership
The Software is licensed, not sold.
We retain all rights, title, and interest in the Software, Website, documentation, graphics, code, product names, logos, designs, presets supplied by us, manuals, installers, measurements, and related materials.
You receive only the usage rights expressly granted in these terms.
Free products, trials, demos, and beta versions
Some Software may be provided as free, demo, trial, beta, preview, or test versions.
Free products may still be protected by copyright and may still be subject to these terms.
Trial or demo versions may include limitations such as audio interruptions, disabled saving, time limits, restricted export, reduced functionality, or other clearly stated restrictions.
Beta or preview versions may contain bugs, incomplete documentation, unfinished installers, changing features, or compatibility issues. Use them with care, especially in important sessions, live work, or client work.
Unless we state otherwise, beta versions are provided for testing and feedback only.
Offline licenses and activation
We aim to provide practical, musician-friendly licensing with minimal nonsense.
Where possible, our paid licenses are designed to work offline and without forced cloud access. Specific activation behavior may vary by product, version, platform, or installer.
You are responsible for keeping your license key, installer files, account details, and backups safe.
If you lose access to your license, contact support and we will make reasonable efforts to help verify and restore access.
Updates
We may provide updates, bug fixes, compatibility improvements, installer changes, manual updates, or new versions at our discretion.
Unless a product page, invoice, promotion, or written agreement says otherwise, purchasing a license does not guarantee free access to all future major versions, new products, paid expansions, or separate editions.
Lifetime, founder, bundle, free-update, or all-products offers apply only as expressly described on the product page, invoice, promotion, checkout page, or separate written offer. Unless expressly stated, a license for one product does not include future separate products, paid expansions, new product lines, custom work, services, hardware bundles, or unrelated editions.
We may stop supporting older versions when maintaining them becomes unreasonable, unsafe, technically obsolete, or incompatible with current systems.
We try not to break old projects, because unlike some software vendors, we remember musicians actually open sessions from last year.
Compatibility
We may provide Software in formats such as VST3, CLAP, standalone applications, or other plugin formats depending on the product and platform.
Supported systems, plugin formats, DAWs, and installation methods are listed on the relevant product page, manual, or download page.
We do not guarantee compatibility with every DAW, host, Linux distribution, Windows configuration, plugin scanner, wrapper, bridge, sandbox, package manager, audio driver, or graphics driver.
You are responsible for checking system requirements before purchasing.
Purchases and payment
Purchases may be processed by us or by third-party payment providers.
Payment providers may collect and process payment details under their own terms and privacy policies. We do not intentionally store full payment card details on our own systems.
Prices, discounts, taxes, VAT, promotions, bundles, and availability may change from time to time.
The price shown at checkout at the time of purchase is the applicable price for that order.
Consumer withdrawal rights and digital downloads
If you are a consumer in the European Economic Area, the United Kingdom, or another jurisdiction with statutory withdrawal rights, you may have the right to withdraw from an online purchase within 14 days.
As a MousePlugins policy, we currently allow consumers to request a refund or withdrawal within 14 days of purchase for paid digital downloads, even where the Software has already been downloaded or the license key has already been delivered, provided the request is made in good faith.
If a refund or withdrawal is accepted, the license ends immediately. You must stop using the Software, uninstall it, delete any license key, installer, plugin file, or protected download that you are no longer entitled to use, and not make the Software or license key available to anyone else.
This policy does not limit your mandatory consumer rights under applicable law. If local consumer law gives you stronger rights, those rights continue to apply.
Refunds
Consumers may request a refund or withdrawal within 14 days of purchase, subject to these terms, good-faith use, and mandatory consumer law.
If a download is corrupted, an installer does not work, a license key fails, or a serious technical issue prevents normal use, contact support. We may provide a fixed installer, replacement download, workaround, updated license, or refund where appropriate.
Refunds do not permit continued use of the Software. If a refund is issued, your license ends and you must uninstall the Software and stop using it.
Refunds may be refused in cases of fraud, piracy, chargeback abuse, repeated bad-faith purchases, abusive conduct, or continued use after refund, without limiting mandatory statutory rights.
Your statutory rights remain unaffected.
Legal guarantee and conformity
If you are a consumer, you may have legal rights if digital content is defective, not supplied, or not in conformity with the contract.
We will not exclude or reduce any mandatory legal guarantee, conformity right, repair right, replacement right, price reduction right, refund right, or other consumer protection that applies under the laws of your country.
Where legally permitted, defects caused by unsupported systems, incorrect installation, third-party host bugs, user modification, cracked copies, incompatible wrappers, unsupported operating systems, or failure to follow reasonable instructions may not be covered.
Support
Support is available through support@mouseplugins.com.
When contacting support, please include useful information such as:
- product name and version;
- operating system;
- plugin format;
- DAW or host;
- installer used;
- description of the problem;
- screenshots, logs, or steps to reproduce where relevant.
We may refuse support for pirated copies, modified binaries, abusive users, fraudulent purchases, or systems that clearly do not meet stated requirements.
User accounts and downloads
If the Website provides accounts, download areas, or license management, you are responsible for keeping your login details secure.
You must not share account access with others.
We may suspend or terminate access if we reasonably believe an account is being used for piracy, fraud, abuse, automated scraping, excessive downloads, license sharing, or other misuse.
Website content
The Website may include product descriptions, screenshots, audio examples, manuals, blog posts, technical measurements, comparisons, compatibility notes, marketing text, and other materials.
We try to keep this information accurate, but errors may occur.
Audio examples, screenshots, measurement charts, and product descriptions are provided for information and demonstration. They do not guarantee that the Software will produce identical results in every system, host, track, signal chain, or audio context.
Third-party names and trademarks
Third-party product names, company names, plugin names, hardware names, trademarks, or references may appear on the Website or in documentation for identification, compatibility, historical, educational, technical, or comparison purposes.
Unless clearly stated otherwise, MousePlugins is independent and is not affiliated with, endorsed by, sponsored by, or approved by those third parties.
All third-party trademarks belong to their respective owners.
Presets, manuals, and included content
Any presets, manuals, sample settings, screenshots, example chains, or factory content supplied with the Software are licensed to you for use with the Software.
You may use factory presets in your music and audio productions.
You may not redistribute our factory preset banks, manuals, graphics, screenshots, or bundled content as standalone products without written permission.
Privacy and analytics
Our handling of personal data is governed by our Privacy Policy.
We aim to avoid invasive tracking and unnecessary data collection. Payment, licensing, email, hosting, analytics, or download services may involve third-party providers where necessary to operate the Website and deliver products.
Please review the Privacy Policy for details.
Security and anti-abuse
You must not attempt to interfere with the Website, servers, downloads, checkout, license systems, accounts, or support systems.
This includes attempts to overload, scrape, scan, exploit, bypass, impersonate, inject malicious code, or gain unauthorized access.
We may block access, cancel orders, disable licenses, or take legal action in response to fraud, piracy, chargeback abuse, account abuse, or security attacks.
Disclaimer of warranties
To the maximum extent permitted by law, the Software and Website are provided "as is" and "as available."
We do not promise that the Software or Website will be error-free, uninterrupted, compatible with every system, suitable for every workflow, or immune from all bugs.
Nothing in these terms excludes warranties, guarantees, or rights that cannot legally be excluded.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, punitive, or economic losses, including loss of profits, loss of business, loss of recordings, loss of sessions, loss of data, loss of goodwill, or studio downtime.
Always keep backups of your sessions, installers, licenses, presets, and important files. This is not just legal text. It is the tiny thread separating civilization from a corrupted project file.
Nothing in these terms limits liability where limitation is not permitted by law, including liability for intentional misconduct, fraud, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights.
Termination
This license remains in effect until terminated.
Your license automatically terminates if you materially breach these terms, including by sharing license keys, distributing paid installers, cracking the Software, or using the Software in a way that violates these terms.
After termination, you must stop using the Software and delete any unauthorized copies.
Sections relating to ownership, restrictions, liability, refunds after termination, governing law, and dispute resolution survive termination.
Changes to these terms
We may update these terms from time to time.
The version published on the Website applies from its stated effective date.
Changes do not retroactively remove mandatory rights you already have under applicable law.
For material changes, we may provide notice on the Website, by email, or through another reasonable method.
Governing law
These terms are governed by the laws of Spain, unless mandatory consumer protection laws in your country provide otherwise.
If you are a consumer, you may also have the right to bring claims in the courts of your country of residence where mandatory law allows it.
If you are acting as a business, freelancer, professional user, company, reseller, or non-consumer, the courts of Alicante, Spain shall have jurisdiction, unless mandatory law requires otherwise.
Dispute resolution
Please contact us first at support@mouseplugins.com so we can try to resolve the issue directly.
We do not currently reference the discontinued EU Online Dispute Resolution platform.
Where applicable, consumers may have access to national or European consumer advice bodies, consumer authorities, or alternative dispute resolution entities.
Entire agreement
These terms, together with the Privacy Policy, the product page, checkout terms, invoice, and any specific license terms shown for a product, form the agreement between you and us.
If any part of these terms is found invalid or unenforceable, the remaining parts continue to apply.
